It also matters that the boundaries and surface area in the land registry match the cadastre, and that there is real access to the road and utility connections. We verify each of these with a lawyer before the reservation.

    In a gated community you pay a community fee and follow its rules, but in return you get 24-hour security, maintained roads and green areas, and shared facilities. It is a convenient choice when the house stands empty for part of the year. A villa outside a community offers more privacy and freedom in how you use the land, but all the upkeep — garden, pool, access road, security — falls on the owner. Before buying, it is worth reading the community statutes and checking the resolutions from recent years.

    The annual budget includes IBI property tax, the waste collection fee (basura), insurance, utilities and garden and pool maintenance. In a gated community there is also the community fee, and on larger plots the cost of irrigation. Owners who are not tax resident in Spain also file an annual non-resident income tax return. We always ask the seller for the last twelve months of bills, so the budget is based on facts, not estimates.

    The starting point is an up-to-date nota simple from the land registry — it shows the owner, mortgages, easements and encumbrances. We compare the surface area in the registry with the cadastre and the actual property, because extensions are sometimes not legalised. You also need a certificate confirming no debts to the community, the first occupation licence and the energy performance certificate. An independent lawyer reviews everything before any deposit is paid.
